ldquo;这是欺诈你知道吗？这是赤裸裸的欺诈行为！”才赶到嘉定区双单路上的“秋霞坊”楼盘，记者即被上百名业主里三层外三层地“包围”其中，对于此次集中前来售楼处讨要说法，业主们显得既无奈又愤恨，“孩子还没出生，四五十万元却‘丢’了，这些钱可都是老人们一辈子的心血，你说让做小辈的怎么办，让父母怎么办？”一位业主当场发飙……
昨天晚间，上海的气温开始下降，在楼盘售楼处门口更是寒风凛冽。不过，即便如此，“留守”讨要说法的一期老业主们却丝毫没有撤离的意思，他们从售楼处搬出数十把椅子，三五成群地坐在门口，其中，有些人还是挺着大肚子的准妈妈。一阵寒风吹来，丈夫忙不迭地给妻子披上围巾，问他们何时打算撤离，业主说，“直到开发商明确给个说法为止。”
往里走，售楼处内部也是一片狼藉，看得出，售楼人员的脸上写满焦虑与无助，一个个默不作声地坐在一边，而他们身边，还有少数听闻大幅打折消息后，前来速速完成签约的新业主，和销售人员的表现类似，他们也没有过多交谈。
事实上，就在昨天下午，仅两三百米开外的“龙湖郦城”售楼处，这里也刚出现了上百名老业主“冲击”售楼处的一幕，记者看到，两处大型沙盘模型被严重砸毁，模型材料被拆开后丢弃在地面上，楼盘售楼处的“金字招牌”也被砸得残缺不堪，几名保安正警惕地在用对讲机互相“保持联络”，大约晚上7点45分，该售楼处正式关闭。
据附近中介透露，老业主抗议开发商降价已进入第三天，昨天冲击“龙湖郦城”售楼处是连日来最剧烈的一次，为此，龙湖地产决定取消打折计划。
闹事业主称楼盘销售存诸多问题
和“龙湖郦城”售楼处相比，绿地集团“秋霞坊”的售楼处景象要好得多，但上百名业主一直到晚上8点多都迟迟不愿散去，业主的诉求是什么？矛盾焦点又在哪里呢？对此，记者采访了其中据称为主要知情人的杨先生。“房价跳水三分之一还不止，几个月下来，直接损失数十万元，最高的还可能达到六七十万，不但如此，除房价缩水，我们还陆续发现了不少开发商的其他问题。”杨先生说，除房价从最高每平方米1.9万元，暴跌到现在最低的1.1万多元外，开发商楼盘的销售过程也存在诸多“不规范”之处。
大致可以分成四点：一，交房时间延后，一位业主在买房时销售人员曾许诺明年3月即可交房，可拿到合同后一看才发现真正的交房时间是明年6月。第二，楼盘得房率存在“欺诈”，杨先生表示，售楼时得房率都宣称78%左右，可事实上，只有73%-74%；第三，楼房质量不过关，“有人拍到照片，连样板房都在漏水，我们房子（期房）的质量又如何保证，门面功夫都做不好，实际的房子更不好。”第四，存在霸王条款。据了解，与开发商签署的合同中，对违约一项，开发商“自罚”仅总额的5%，而对业主却有总额20%的违约金，明显存在霸王条款，另外，在签合同时，售楼人员都称现为“最后几套房”必须让购房者迅速完成签约，“说白了，就是‘逼’着你几分钟内签完合同，完全没机会详细看那些名目繁多的合同条款,abercrombie。”
鉴于这些问题，老业主们遂向开发商讨要说法。
记者在现场还采访了“秋霞坊”售楼处经理卢先生，对于记者提出的问题，他三缄其口，并强调，采访需由公关部门出面，自己不能多说。不过，从他向业主们解释的内容中记者听到，原本卢先生曾许诺下周六之前公司会有高层领导出面解释，但现在已提前为下周一高层领导出面，具体时间和其他相关事宜暂不清楚。

业主诉求很难获支持
盈科（上海）律师事务所的李文华律师认为，业主们的诉求很难被法院认可。
他指出，从司法程序上看，房价下跌导致经济损失是不能得到赔偿的，房地产置业本身就是一项存有风险的商品交易，这一点业主应有所了解。
另外，就开发商所涉嫌的有关得房率、交房时间不符、霸王条款等违规问题，只要业主在合同上签了名，就表示获得了当事人的书面“许可”，无论销售人员之前如何“承诺”都很难得到法院支持，而样板房漏水更是无法作为指责开发商的“质量不过关”的证据。“毕竟你买的不是样板房，质量好不好得根据自己房屋的实际情况而定，如真不过关，交房后可通过司法途径索赔。值得提醒的是，一般情况，质量不过关主要也还是以开发商‘修补’为主，除非房屋结构存重大安全问题，可向司法部门主张退房。”
